What is DSA?
The Digital Services Regulation or Digital Services Act (DSA) is a European Union (EU) regulation (Regulation (EU) 2022/2065), that provides a set of rules and obligations applicable to online intermediaries offering services within the EU (including online platforms such as Wallapop).
How this rule affects freelancers and companies
According to the DSA, online platforms such as Wallapop that allow consumers to enter into distance contracts with professionals (whether freelancers or businesses) must collect and review certain information and documentation pertaining to these professionals.
Therefore, if you have identified yourself in your account as a "professional" user, you must provide the information and documentation indicated below according to the steps outlined in the following section. Note: This requirement does not affect the collection and reporting obligations imposed by Directive 2021/514 (DAC7). (Click here for more information about DAC7.)
How to fill out the required information and attach documentation
In order to provide the information and attach the documentation, go to the following section: You > Configuration > Your legal information.
Once you have filled out the form, we will review it and notify you of the results. If we are not able to review the information satisfactorily, we will let you know so you can correct the problems detected.
To do so, click on the link in the notification to access the "Your legal information" section. The fields that generated errors in the review will be highlighted in red so that you can find and correct them.
Remember, you can always edit the information or documentation using this form. Please make sure that your information is up to date at all times. Please be aware that if you modify information or upload additional documentation, the form will be reviewed again.
What information and documentation do I need to provide?
The information and documentation to be provided is different depending on whether you operate professionally as a freelancer or a company. You must indicate whether you are "self-employed" or a "company" at the top of the form.
If you are self-employed, you must include the following information:

Identification data, including the following:
- Your first and last names. Please note that your data will be publicly available on your Wallapop profile, as required by the DSA.
- A customer service phone number and e-mail address. Please note that this data will be publicly available on your Wallapop profile, as required by the DSA.
- Your primary residence address and business address. Please note that your business address will be publicly available on your Wallapop profile, as required by the DSA.
- Your tax identification number (NIF) and a copy of your identity document.
- Your VAT number (optional). This is the unique number that identifies a taxpayer for value-added tax purposes.
- A declaration stating that you promise to offer only items or services that comply with the applicable regulations.
If you operate through a company, you must provide the following information:

Identification data, including the following:
- Company name. You must enter the name of the company in this field. (For example, "Company, S.A.," "Company, S.L.," etc.)
Please note that this data will be publicly available on your Wallapop profile, as required by the DSA.
- Company registration number. In this field you must include information about the registration of the company in the business register ("registro mercantil"). (For example, "volume 43.796, folio 21 and sheet B-438.613.")

- Name of the business register where the company is registered. (For example, "Barcelona Business Register" or "Madrid Business Register.")

Type of company, choosing between:
- Listed company. Select this option if the company has listed shares that can be bought and sold on a stock exchange.
- Company related to a listed company. Choose this option if the company is related to a company that has listed shares that can be bought and sold on a stock exchange. A "related" company is defined as a company that is controlled by a listed company or is subject to the same common control as that company.
- State entity. You must select this option if the entity is wholly owned by a government agency, or is an institutional body or agency owned by a government agency.
- None of the above. Select this option if none of the above options are applicable.
- A customer service phone number and e-mail address. Please note that this data will be publicly available on your Wallapop profile, as required by the DSA.
- A "nota simple" from the business register. The "nota simple" is a document issued by the business register in which the company is recorded; it includes information about the company's business.
- Address of the registered office. Please note that this data will be publicly available on your Wallapop profile, as required by the DSA.
- Tax identification number (NIF).
- Your VAT number (optional). This is the unique number that identifies a taxpayer for value-added tax purposes.

Permanent establishment in the EU.
- If your company has permanent establishments in other countries in the European Union, you must check the option "I have one or more permanent establishments in the EU." You must then indicate the countries where these permanent establishments are located.
- If your company does not have any permanent establishments in other countries in the European Union, you must check the option "I do not have permanent establishments in the EU."
- A declaration stating that the company promises to offer only items or services that comply with the applicable regulations.
What happens if you do not complete the form?
As mentioned above, if you use our platform as a professional we have a legal obligation to request this information and documentation.
Therefore, when a new user registers on Wallapop and indicates that he/she is a professional, he/she must fill out the form. If the form has not been completed or the information and documentation provided has not passed review, the user will not be able to upload items to Wallapop.
If you are already a registered user of Wallapop, be aware that you must provide us with this information or documentation before February 17, 2025. If you have not done so by this date, all of your published ads will be hidden and you will not be able to upload new ads on Wallapop until you have completed the form and it has passed the review process.

If you are self-employed, you will provide us with personal data. In this case, Wallapop, S.L., as the data controller, will process these data to incorporate them into the information linked to your profile and comply with its legal obligations.
